I decided to take the time and find out a way to contact TAITO. Seeing as there were no contact options on the English site I browsed through the Japanese version of their site and found a web-form to contact them.
After a week I finally got a response, hopefully it's true what they say:

I'm sorry to put you to so much trouble　that achievement
called:”Escapologist” of EXIT for XBLA does unlock.
We make an effort to solve the problem early.
The correction version is scheduled to be uploaded in the of March or
beginning　April.
I'm sorry to keep a xbox live user waiting.

If it happens that is great news for all of us who bought the game.  I myself have been sitting at 1 level shy of the Escapologist (with allllll of those future levels unplayed hehe).

Let's hope it holds true. It's currently almost mid April but still no patch...

Not looking good. Let's also hope the achievement will unlock for those of us who have already achieve 5000 points in the first 50 levels if a patch is actually in the works.

So did it come through or what? I bought it around two weeks ago and haven't seen an auto update.

It's fixed now. 

The update just popped up a few minutes ago while I was playing.  I went back and replayed a level in situation 5 and Escapologist unlocked.
