Oh yes. If you have a legit copy they say they will not ban you. But I have seen people that supposedly have a legit copy get banned. Normally a console ban is forever. Now they seem to be checking some peoples claims of innocence.

no, the xbox live enforcement team will not take action on a member of the service that has a legitimate retail copy of a game. they will, however, take action on people who have modified their consoles to play illegally pirated games.

I think what's happening is that playing MW2 early is drawing attention to the users. Even if the copy of the game is "legit", which i find funny because we all know the game isn't for sale. Legit is buying a copy, not stealing a copy. Just because it's an actual copy of the game and not pirated, does make it "legit". Anyway, even if the copy of MW2 is Legit, it's drawing attention to the console, which is probably modded. Resulting in the ban. Even if you have a "legit" copy, if you have a modded xbox, you might want to stay offline with MW2 until it launches.

Agreed with beediz-it's a lot easier to check out fewer people that are playing a game pre-release.

If you have a legitimate bought copy of the game, and you are going to play it on an unmodified console.  Play away, have fun.  You will NOT be banned.  It is only people like the OP who have downloaded an illegal copy of the game and is playing it on a modded console who will get banned.

You shouldn't be banned for that? I got my game on friday! pre-order and hey called to say it was in.. picked it up and played it already... he was saying that only the prestige came in.... awesome game so far!!! so much more than the last one!
