So, the game I have been waiting for is due out next Tuesday, Call of Duty MW2.....however, I have been fortunate enough to have my pre-order delivered today . Here in lies my dilemma...to play or not to play CoD games have to be one of my all time favourites, so just looking at it is getting my trigger finger twitching

The only thing is, I don't want to start enjoying the game only too then find I wind up getting banned I know people have said that as long as the game is legit you will be fine. Does anyone know if this is actually true?

If you have a legitimate bought copy of the game, and you are going to play it on an unmodified console.  Play away, have fun.  You will NOT be banned.  It is only people who have downloaded an illegal copy of the game and is playing it on a modded console who will get banned.

If you do get banned you have proof of the reciept that it's a legit game.

This is very true, but it would be the whole process of going through proving it's all legit and the phone calls etc, etc But I think this is just one game I am going to have to slide in early and play

In that situation you wouldn't call MS as they do not deal with console bans. Only XLET (xbox LIVE Enforcement Team) do and you can get in contact with one of them here on xbox.com.

If it were me, I would wait.  I read all of these posts about playing games early.  Where some of them really aren't supposed to have the games and knew it, some didn't know any better.  I honestly don't know what to think. 

Do you have a few hundred dollars to buy a new console right now if you and other people here, including mods, are wrong?

My buddy just got his copy today, hes from Germany so I dont know if it has anything to do with it. I heard that there is a postal strike over there at the moment so maybe that has something to do with it - stores pushing out the ship date early so people who preordered it wont blow a gasket when it doesnt arrive on the 10th.

No.  Any references to World War 2 German soldiers (their name invoke the swear filter in these forums) in the games were banned.  Not the games themselves.

However, playing the game early will draw attention from MS. If you are playing a legit copy, but on a modded console then prepare for a ban. However if you have done nothing wrong then you have nothing to worry about. Play the game when you get it and have fun...that is if you bought it from a legit retailer. You didn't get it off of eBay did you?
