Playing legitimate games early will not get you banned. However, simply having a modded console is enough to get you banned. Simply playing the game early on a modded console will draw the Enforcement Team's attention and you will be banned.
It's good that you mentioned this because this is the same situation a LOT of people are finding themselves in right now. They no longer play pirated games or whatever they did before. Then, they get on and finally get banned and claim they did nothing wrong. People need to realize it's not if the Enforcement Team catches them, it's when. It doesn't matter how long your record has been clean. If you did something before and you have not received punishment for it, the punishment is coming... eventually.
