How do you know they are using an Illegal Copy? You could report that but how would you know? MS is already laying down the ban hammer for modded boxes playing illegal copies , so they know better than you if its an burned game by what ever means they use to determine this. A game before release date is not an Illegal Copy and not in violation of the MS EULA, the store however might be in violation with an agreement from there distributor ,but mom and pop stores are most likely not signing such an agreement because they are not purchasing in such high volumes as a gamestop.
Currently there are over 30000 people playing multiplayer and most if not all are Legit Copies, those who have modded boxes are not playing online, unless they are really stupid.
As other users have posted. Mom and Pop Stores , and one other posters comment that was rather racist but also percentage wise rather true as well. Stores are supposed to Sell the game on the release date and Major Chains will adhere to the street date. Mom and Pop stores tend not too because they cant compete to the volume of say a GAMESTOP, plus they can put a premium on it like an extra $10 and nobody really cares and will pay that. So if you live by a major city and not in Middle America , just call your local gaming stores , some of them should have it unless sold out. There have been people on yesterday that were from UK and France so the major city thing applies everywhere.
Don't hate the people because they are playing it, they purchased it. Tuesday all the Rankings will be Reset so it will be a fairly level playing field. It's only another 2 days, you can wait and it is well worth it.
P.S. Someone on last night said that the GAMESTOP called them, so that employee will probably be fired but you could call that major stores as well someone might sell it, WALMARTS and SEARS are usually good for that as well.
