I heard Steptoe on Major Nelson's podcast say that if you're playing a game that has had street date broken by a retail store, you're fine.  So long as you've got your receipt as proof... :)

You cannot be banned for playing legitimate copies early. Such would be in breach of Australian consumer law. Major Nelson has also stated this. I really wish people would stop the scaremongering.

Easy to way to tell if they do.

If they say "We cant sell it to you yet." Instead of "We don't have it." you know they've figured out they cant sell it Stick out tongue [:P]

...and yes I know what the link states, that's what I am not sure they will sell it tomorrow. But hey I know how much *** we get in at work if a catalog says something and we refuse to sell it to them for that price. All you can do is try.

Yeah, I know exactly what you mean. Working at K-Mart you get so much *** like that.

I am pretty sure this game will be sold tomorrow. Chances are they have it in stock, for example at work last night I came across a box full of some book that is not being released until November 16th, but we already have it in stock sitting out the back and it just has stickers and red tape saying do not open until November 16th. But, things like that still need to be put into the system and checked for major faults and ***, so the boxes are already opened. Chances are if the store has opened it's boxes and the game is on the system, you'll be able to get yourself a copy. I'll be heading in tomorrow morning though, see if I can grab one.

Actually the catalogue doesnt revolve around MW2, the game just happens to come out at the time of the catalogue, whether its at the start or the end. Bloody hell, whats wrong with all you people, why are most of you so absent minded ????.  Ask yourself this question, why would BIG W be the only retailer who has stock now, before anybody else, JB dont EB dont, i think the staff member at big w didnt really have a clue what was going on and only thought , oh well its in the catalogue doesnt start till tomorrow, so come back tomorrow, probably doesnt know the difference between MW2 and a britany spears cd. !!!

I havent seen the Big W catalogs,  but if they claim in them that MW2 is being sold tomorrow ie its listed and doesnt have "Comming Soon" or "Available X" and the catalog is dated started tomorrow, I would assume the same principle applies. They have to sell it to you....if they have it.

An ‘invitation to treat’ is a contract law concept that means displaying an item with a marked price does not constitute a binding offer to the world at large; rather, it constitutes an 'invitation to treat', or an offer to deal with the trader concerning the item and as such the retailer has the option to withdraw the item from sale.

Sweet, Friday in the Manager's Meeting I'm going to suggest every time someone comes to the checkout with items that are on special, we simply withdraw the item. It's going to save us thousands.

Again, just because an item is in a catalogue,  they are under no obligation to sell it to you, for 2 reasons firstly its under an embargo, and secondly they dont have stock, which in this case relates to both.
No where in the BIG W catalogue do they claim its available tomorrow, its the "CATALOGUE" that starts tomorrow not a particular item available tomorrow, where are you dreaming this stuff up.

A retailer does have the right to remove an item from sale though...

Yes but it also doesnt say the game is only avaliable on 10th, one would have to assume that the game is avaliable when the sale startsStick out tongue [:P]

Exactly...if you look at a JB Hi-Fi catalogue for instance it will tell you in a little speach bubble or something "Out Nov 10th" or something along those lines. See link http://www.jbhifi.com.au/games/microsoft/x-box/360/ Also to all those saying they won't have it in stock yet, my local EB games has recieved their shipment...they just know about street dates lol

Its a marketing ploy used widely to get you into the store, then you will be told they do not have stock or in many cases, "we have sold out" in the hope you will say oh well im here now and buy something else. Taking a catalogue as though its set in stone the game will be sold is laughable.

I work at Big W, they won't sell it to you. My store doesn't even have the stock yet. They will come in with huge embargo stickers with the realease date over the boxes that only managers are meant to open. So if you're lucky you may get some dumbass to ignore all the labels and warnings, but don't count on it. You can get angry but it won't get you the game, not at my store atleast.

Goodluck though!

Ah no,  as i said just because its printed in a catalogue and it starts on a particular date, its not law that everything in it will be available on the date it starts. In this case it might be a case of someone not proof reading before publication or simply an oversight on Big W's part. And yes it is available on the 10th.

Most likely there will just be a notice at the entry to Big W stating of the miss print in the current catalogue. Same as how JB last week had the advertising of Forza 3 a day early.

I work full time in sound and vision at kmart. There's no chance it'll go out before 10th. We get bullitins from head office passed on by activision Australia. You get sued if streets broken, so yes most are locked away until the 10th. Can't people wait 6 days anyway?

Didn't stop K-Mart from selling Fbale II early which resulted in them receiving a $10,000 fine and having to wait 2 weeks before being able to sell Gears 2.

You never know might be true might not be.. I'll wait to see if anyone does pick it up by end of the week.

Forza was in local jb before our kmart. New titles that are streeted usually go out the night before the day for store open next day. It's a dim witted casual who would put them out during trading hours. We got bullitins for odst and MW2. Forza wassticketed but not bullitened, but we still kept in lockup for street date. If you're really eager for MW try on weekend as that's when trigger happy casuals are on
