There has been issues with the recent TOU and it asking for parental controls, even if they are not currently enabled on your console. To fix this issue, you will need to contact XBOX Support via phone and talk to an "Account Specialist" to help solve your issue with the TOU. To do so, go to the following link:
Do not post personal info like your email address on the forums.
There is a service alert connected to this at the moment so you will just have to wait until it's fixed i'm afraid.

the other option and this is advisable is to get the owner/parent of the email address to go to login.live.com to reset there password.
